In the state of Michigan, USA, it refers to a 4th time habitual offender with three or more prior felonies or attempts to commit felonies. The # doesn't get any higher and it begins at MCL 769.10, then MCL 769.11. Judge's/prosecutor's have the discretion to sentence a 769.12 to any # of years to life for a felony that normally would carry five year's or more in prison. However most will just get a heftier sentence that is often more than double, or even quadruple of that of a first time offender and a min term equal to that of the usual tail end penality. Sometimes, but rarely a 769.12 gets probation for lower lvl felony, but only in circumstances with high mitigating factors with the help of a special private attorney. For a felony that normally carries a max of four year's the max penalty is up to 15 year's. They commonly r seen on OTIS with face and neck tattoos, with a stereotypical intimidating, drugged out or hardened, expression on their mugshot. Many if not most of these ppl can't be trusted around your car keys, your money/assets, valuables, your social security number, your children, your female life partner, or being in charge of funds at a workplace. Most of them seem to meet the criteria for conduct disorder, and/or grew up in broken home's, never had a stable functional life and often were never taught how to make honest money. Watch out for them, as all they typically know how to do is to treat the world like a prison yard.
